License

1. Licence
   These terms, when accepted by the authorized customer ("user") of the Archivemaker software ("Software"), form a licence ("licence") agreement between Simmaco SAS ("Simmaco" or "the company") and the user for the trial use of the Software, including any and all versions or variations of the Software, and any future fixes, updates and upgrades provided.
   THE SOFTWARE IS PROVIDED "AS IS", AND ON AN "AS AVAILABLE" BASIS AND THERE ARE NO CLAIMS, REPRESENTATIONS AND WARRANTIES MADE BY SIMMACO, EITHER EXPRESS, IMPLIED OR STATUTORY (TO THE EXTENT PERMITTED BY APPLICABLE LAW), WITH RESPECT TO THE SOFTWARE, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, NOR ARE THERE ANY WARRANTIES CREATED BY COURSE OF DEALING, COURSE OF PERFORMANCE OR TRADE USAGE.
   
   With the present contract, for the trial period of time specified by the company, Simmaco grants to the user straight following:
   
   1. installation and use of the Software.
      Except as explicitly stated in the present agreement, the user can only install, use, approach, execute or otherwise interact with one copy of the Software installed on one computer;
   2. backup copy.
      The user can create one only backup copy of the Software. The user is authorized to use the backup copy only for archives requirements. The backup copy must include all copyright information contained on the original. Except as expressly permitted in this Licence, the user agrees not to reverse engineer, de-compile, disassemble, alter, duplicate, modify, rent, lease, loan, sublicense, make copies, create derivative works from, distribute or provide others with the Software in whole or part, transmit or communicate the application over a network.
   WARNING: THE USE OF THE SOFTWARE GRANTED BY THIS AGREEMENT, IS FOR TRIAL PURPOSES ONLY; ALL DATA STORED, GROUPS OR ARCHIVES STRUCTURE CREATED, SETTINGS OR POLICY IMPLEMENTED BY MEANS OF THE SOFTWARE AND UNDER THIS TRIAL LICENSE, IS STORED IN A TEMPORARY DATABASE, AND MAY BE CANCELED WITHOUT WARNING AT ANY TIME.
   
   In addition, the user agrees not to use the Software to:
   1. Transmit or communicate any data that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
   2. Harm minors in any way;
   3. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
   4. Forge headers or otherwise manipulate identifiers or metadata in order to disguise the origin of any data transmitted to other users;
   5. Transmit, access or communicate any data that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non-disclosure agreements);
   6. Transmit, access or communicate any data that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
   7. Transmit or communicate any data that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
   8. Disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
   9. Interfere with or disrupt the Software;
   10. Intentionally or unintentionally violate any applicable local, state, national or international law, including securities exchange and any regulations requirements, procedures or policies in force from time to time relating to the Software;
   11. Monitor traffic or make search requests in order to accumulate information about individual users;
   12. "Stalk" or otherwise harass another;
   13. Modify, delete or damage any information contained on the personal computer of any user;
   14. Collect or store personal data or other information about other users; or
   15. Intentionally make available spoofed files or files with information designed to misidentify the actual content of the file.
2. General Restrictions.
   You shall not (nor shall You permit anyone else to) directly or indirectly:
   1. copy (except as expressly set forth above), modify, or distribute the Software or any portion thereof;
   2. reverse engineer, disassemble, decompile or otherwise attempt to discover the source code or structure, sequence and organization of the Software or any portion thereof (except where the foregoing is permitted by applicable local law, and then only to the extent so permitted);
   3. rent, lease, or use the Software or any portion thereof for timesharing or service bureau purposes, or otherwise use or allow the use of the Software or any portion thereof for any commercial purpose or on behalf of any third party;
   4. remove or obscure any proprietary notices on the Software;
   5. develop products or software applications based on the Software, unless otherwise stated by Simmaco by mean of a further and different agreement.
   As a specific condition of this license, You agree to use the Software in compliance with all applicable laws, including without limitation copyright laws, and that You will not copy, transmit, perform or distribute any audio, video or other content using the Software without obtaining all necessary licenses or permissions from the owner of the content.
3. Copyright
   All the rights of intellectual property related to the Software (including, but not limited to, every image, photography, animation, video, audio, music, data base and text), all enclosed printed material and whichever copy of the Software, is property of Simmaco and its licensors.
   The present agreement does not entitle for the use of any content available by means of the Software; the use of such content is disciplined by the copyright status of each file (i.e. but not limited to, images, photographies, animations, videos, audio, music, data base and text).
   
   The use of any on line service the user can approach by means of the use of the Software, is disciplined by the relative conditions of use.
   
   Any action, reserved to the holder of the rights by the national and international laws in matter of intellectual property or copyright, made without the authorization of the holder will be legally sued.
4. Regimen of responsibility
   The user remains the only responsible for whichever damage, directed indirect or consequent, deriving to the user and/or thirds party as a result of whichever use or misuse, or for the lack of use, of the information, the material and the services supplied by means of the website.
   The holder of the website is not responsible for the direct and indirect damages, included also, without limitations, the damages for loss or lacked gain, interruption of the activity, economic information losses, however experienced by the user and/or thirds party as a consequence of the use, or the lack of use, of the website and/or all or part of its contents and/or services.
   The present clause about the regimen of responsibility doesn't limits neither excludes the responsibility of the holder of the website in the cases in which it cannot be excluded in force of the law
5. Applicable Law
   The present agreement is subject to the Italian law, or subordinately, to that of the country of the user, in case this last one imposes its application for the acknowledgment of the validity and/or the effectiveness of the present agreement.

The JXS library is subject to the terms specifies by the LGPL licence.
The XERCES library is subject to the terms specifies by the Apache licence.
